Please read these terms carefully before using our services

Welcome to TCS Healthcare. These Terms of Service ("Terms") govern your use of our home healthcare services, websites, mobile applications, and related platforms (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. Please read them carefully.

1Acceptance of Terms

By accessing or using TCS Healthcare Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms that may apply to specific services.

  • You must be at least 18 years of age to use our Services
  • You agree to provide accurate and complete information
  • These Terms constitute a legally binding agreement
  • If you do not agree, you must not access or use our Services

2Description of Services

TCS Healthcare provides comprehensive home healthcare services designed to support individuals in maintaining their health, independence, and quality of life. Our Services include:

Personal Support Services (PSW)

Assistance with daily living activities including bathing, dressing, grooming, and mobility support

Nursing Care

Skilled nursing services including wound care, medication management, vital sign monitoring, and health assessments

Companion Care

Social companionship, meal preparation, light housekeeping, and transportation assistance

Specialized Care

Dementia care, palliative care, post-operative recovery support, and respite care

SMS & Text Message Communications

Tailored Care Solutions offers the following services over text messages:

  • Appointment reminders and scheduling notifications
  • Care coordination updates and alerts
  • Important service announcements
  • Caregiver arrival notifications

Message frequency varies. Message and data rates may apply. Text HELP for assistance. Reply STOP to cancel. Carriers are not liable for any delays or undelivered messages.

3Eligibility

To use our Services, you must meet the following eligibility requirements:

  • Be at least 18 years of age, or have a legal guardian who can enter into this agreement
  • Reside within our service areas in Ontario, Canada
  • Provide accurate health information for care assessment
  • Maintain a safe environment for caregivers to work
  • Have the legal authority to make healthcare decisions or have a designated healthcare proxy

4Service Agreement

All care services are delivered according to an individualized care plan developed in consultation with you, your family, and our healthcare professionals. The service agreement includes:

  • Comprehensive health assessments conducted by qualified professionals
  • Personalized care plans tailored to individual needs and preferences
  • Regular care plan reviews and updates based on changing health status
  • Service schedules based on your care plan and caregiver availability
  • Your consent and signature before services commence

5Payment Terms

Billing for Services is conducted according to the following terms:

  • Services are billed at rates specified in your service agreement
  • Invoices are issued on a bi-weekly or monthly basis as agreed
  • Payment is due within 30 days of invoice date
  • Accepted payment methods: credit card, bank transfer, and authorized direct billing
  • Late payments may incur interest charges at 1.5% per month

We accept most major private insurance plans and work with government-funded programs (e.g., OHIP, veterans benefits) where applicable. You are responsible for verifying coverage with your insurance provider.

6Cancellation Policy

To ensure efficient service delivery, the following cancellation policies apply:

24+ hours notice:No cancellation fee
Less than 24 hours:50% of scheduled service cost may apply
Same-day / No-show:Full service cost may be charged

7Client Responsibilities

To ensure safe and effective care delivery, you agree to:

  • Provide accurate and complete health history and medical information
  • Disclose all relevant medications, allergies, and health conditions
  • Maintain a clean and safe home environment for caregivers
  • Notify us of any changes in health status or safety concerns
  • Treat all caregivers and staff with respect and dignity
  • Respond to communications from TCS Healthcare in a timely manner

8Limitation of Liability

To the fullest extent permitted by applicable law:

  • TCS Healthcare provides Services on an "as is" and "as available" basis
  • Our total liability shall not exceed fees paid in the preceding 12 months
  • We are not liable for indirect, incidental, or consequential damages
  • Nothing excludes liability for death or personal injury caused by negligence

TCS Healthcare maintains comprehensive professional liability insurance to protect both our clients and our organization.

9Intellectual Property

All intellectual property rights in connection with the Services are owned by TCS Healthcare or its licensors:

  • The TCS Healthcare name, logo, and branding are trademarks
  • All website content, software, and platform features are protected by copyright
  • Care protocols and training materials are proprietary
  • Your personal health information remains your property, subject to our Privacy Policy

10Termination

Either party may terminate the service relationship under the following conditions:

  • Client Termination: You may terminate Services at any time with 7 days written notice
  • TCS Termination: We may terminate with 30 days notice, or immediately for safety concerns or breach
  • Effect: All outstanding fees become due immediately upon termination
  • Data Retention: Health records retained per applicable healthcare regulations

11Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein.

  • The courts of Ontario shall have exclusive jurisdiction over any disputes
  • We comply with the Personal Health Information Protection Act (PHIPA)
  • We comply with PIPEDA and all applicable professional standards
  • Any legal action must be commenced within two (2) years of the event
